State Supreme Court Overruled Plumbing Case
The Ohio Supreme Court announced last November 20 its decision to reject to review a plumbing case. This court ruling over a drainage dispute last 2002 was in favor of the Henry County Engineer.
According to an article published online at Ohio County Journal, the litigation surfaced last 2005. Rodney and Richard Rohrs filed a suit against the county engineer and staff after completing a drainage project acres away from their farm. However, the solution that consisted of filling the ditch, laying tiles, and reclassifying the work as a road safety improvement, backfired and flooded the land.
The drainage system was installed in 2002. And a year after, in 2003, part of the farm land was engulfed by water. With the failure to locate which drainage tile is causing trouble, county engineers opted to install a catch basin. Nevertheless, this solution did not actually quite solve the problem.
